Welcome to the “oh so exciting” SpinoutDay Terms and Conditions page. Of course, it goes without saying that these apply to the website found at www.spinoutday.com. What do these terms and conditions specifically refer to? Good question. They refer to the following fantastic products and services, which may be purchased or accessed via our websites:

Experience Vouchers & Gift Certificates

  1. Experience Voucher – a SpinoutDay voucher for a specific and thrilling experience of your choice. Experience Vouchers are not issued with a specified monetary value. Keep in mind that an Experience Voucher cannot be redeemed for cash and is not a gift certificate, gift card or prepaid store card.
  2. Gift Certificate – a SpinoutDay voucher with a dollar value that can be used as currency to purchase from a SpinoutDay website. Gift Certificates cannot be redeemed or exchanged for cash.
  3. Direct Ship Items (SpinoutDay Gift Boxes, Flowers and Movie Tickets)
  4. SpinoutDay Account credits. These are credits applied to SpinoutDay customer accounts which carry a dollar value that can be used to purchase from a SpinoutDay website.

Throughout these terms and conditions, the above products and services are collectively referred to as ‘SpinoutDay Gift(s)’. Experience Vouchers are referred to as “Vouchers” .

  • When you purchase and/or use a SpinoutDay Gift and tick the box that says 'I understand and accept the Terms and Conditions', you become legally bound by these terms and conditions. Are you in a big rush? Well, you should still read these terms before you accept them.

    Please do not proceed to purchase/use your SpinoutDay Gift until you have read, understood and accepted these terms and conditions. If you have any queries, please contact us and we will be pleased to assist. (We’re also happy to read this very long document to you over the phone if you have an hour of free time and want to hear our voices ramble on for awhile ! )

  • Our goal is to make refunds straightforward and convenient. While we expect everyone will love his or her experience, we understand that sometimes unexpected situations can occur.

    Refund requests for experience vouchers can be honored if they are received within 14 days of purchase. The person who originally made the purchase must make the request. Additionally, all refund payments will be made using the original payment method. Once you have requested a booking, your voucher cannot be cancelled and is not refundable. The refund excludes any delivery or transaction fees paid at the time of purchase. Please just contact us at support@spinoutday.com with any questions about our refund policy.

  • All sales are final for gift certificates and gift boxes. Once a gift certificate or gift box has been purchased or dispatched, an exchange is no longer possible.

  • SpinoutDay complies with the Consumer Protection Law in respect of guarantees and warranties for our products and services. In respect of products it is our responsibility to ensure the products (e.g. gift boxes and their contents) are of acceptable quality, free from defects and fit for the purpose considering the prices and description provided to you at the point of sale. If the product does not fulfill any of these criteria then we will consider a refund based on each case so long as the complaint is made to us upon receipt of delivery.

    In respect of services it is the independent Experience Providers who provides the experience to you following the redemption of an experience voucher. That’s why we look to work with only the best providers.

    The independent Experience Providers accepts responsibility for compliance with the Consumer Protection Law in respect of services that is that the experience was provided with due skill and care and complied with the description made to the purchaser at the time of sale. (SpinoutDay is not the provider of the experience; see part 21 Providers of Experiences.) Subject to the Experience Providers recommended booking notice period, cancellation policy or weather guidelines, you may be entitled to a refund of whole or part of the purchase price depending on the circumstances of each case.

  • Yes, we are definitely happy to facilitate exchanges. Keep in mind that exchanges are only permitted for experience vouchers that are valid. If a voucher has been activated already, it cannot be exchanged. Additionally, vouchers can only be exchanged once without incurring an administrative fee. $10 administrative fee will be accessed thereafter.

    If you exchange your voucher for an experience of lesser value, the remaining value will stay on your SpinoutDay account. If you exchange your voucher for an experience of higher value, you will need to pay the difference.

    Exchanging a experience voucher does not change expiration dates. In other words, your credit will expire on the same date as your original voucher.

  • Exchanges do not apply to Gift Certificates.

  • Once a SpinoutDay Gift Box has been purchased and dispatched, it cannot be exchanged. Plus, you might hurt someone’s feelings! 

  • We are highly reasonable people, but we still reserve the right to change prices without notice. All pricing is exclusive of Sales Tax and will be added in the final payment screen at the current rate of 7%. Exempt from this rule are the sale of gift certificates as they are not taxable. When a gift certificate or a part thereof is redeemed, the transaction becomes taxable. All orders carry a flat transaction fee, which is clearly displayed on the final payment screen.

  • These may not be transferred under any circumstances. Account credits carry the same expiry date as the original Experience Voucher.

  • Transfer does not apply to Gift Boxes

  • If your gift recipient has lost a experience voucher, he or she may be eligible for a replacement as long as the voucher is still valid and has not been used or exchanged. We will need proof of purchase, ordering information such as order number, as well as the purchaser’s name and email address.

  • SpinoutDay experience gift vouchers are valid for the experience purchased for twelve (12) months from the date of purchase, i.e. the Issue Date. SpinoutDay vouchers not redeemed and used within the twelve (12) month period are valid for services equal to or less than the original purchase price of the experience voucher. If you have any questions regarding the use of a SpinoutDay experience voucher please contact SpinoutDay Customer Service at 1 (888) 210-8802 or email us at support@spinoutday.com

  • SpinoutDay Gift Certificates do not expire.

  • It is the responsibility of the purchaser to correctly address gifts, whether by email, post or courier. So be sure to save yourself future hassles and double (and triple) check the address you are using.

    SpinoutDay cannot be held responsible for any damaged, missing or delayed orders where incorrect or incomplete delivery details (address and, if relevant, appropriate delivery instructions) have been provided. All Experience Vouchers and Gift Certificates are dispatched from our trusted SpinoutDay fulfillment partner based in Miami, FL 33139.

    A redelivery charge will apply (depending on the delivery method chosen) if the item is lost after receipt, if the recipient is unavailable for receipt of delivery, if the delivery address is incorrect or if there is no safe place to leave the item.

  • And there is yet more stuff we aren’t responsible for… read on! SpinoutDay is not liable or responsible for any loss suffered as a result of an Experience Voucher or Gift Certificate via email being blocked by filters or firewalls, or where the purchaser has entered the incorrect email address. (So again, double and triple check your email addresses!)

    Oh no! What if your recipient does not receive his or her email Gift Voucher? If this occurs, don’t panic. Instead, please contact us immediately on 1 (888) 210-8802 to send vouchers to an alternative email address. Alternatively, we can change the delivery method, which would incur the normal delivery fee of that service.

    The mail usually does a great job. But every now and again, sometime can go wrong. So what happens if it does? SpinoutDay accepts no responsibility for any damage, loss or delay as a result of using US Postal service or FedEx services. We can provide you with the tracking code to contact FedEx/ US Postal service in the event you need to locate the whereabouts of your delivery. FedEx and US Postal service only guarantee next day delivery to specific zip codes nationally, which you can find on their websites. A redelivery charge of $10 will apply if the item is lost after receipt, if the recipient is unavailable for receipt of delivery, if the delivery address is incorrect or if there is no safe place to leave the item. SpinoutDay accepts no responsibility for any damage, loss or delay as a result of using this service. Delivery charges are non-refundable. We make no guarantees with regards to delivery dates and times. For Corporate Orders Only - should you have a deadline delivery prior to 11am, the additional cost of a priority service courier will be charged.

  • The term “Direct Ship items” refers to SpinoutDay Gift Boxes, Flowers and Movie Tickets. Once again, everyone, double-check the address of your recipients! It is the responsibility of the purchaser to correctly address gifts. SpinoutDay cannot be held responsible for any damaged, missing or delayed orders where: Incorrect or incomplete delivery details (address and, if relevant, appropriate delivery instructions) have been provided. It has been requested that the item be left unattended. We strongly recommend using a business address for delivery. Residential addresses may cause missed delivery issues.

  • Sending a SpinoutDay Gift box? Great idea! Here are some things you should know. SpinoutDay Gift Boxes are normally dispatched via FedEx. SpinoutDay accepts no responsibility for any damage, loss or delay as a result of using this service. Couriers deliver between 9am and 5pm (Monday to Friday) and specific dates and times cannot be guaranteed. All Gift Box deliveries must be signed for (unless specified to leave unattended) and we cannot deliver to PO Boxes. A redelivery charge of $20.00 will apply if the recipient is unavailable for receipt of delivery, if the delivery address is incorrect or if there is no safe place to leave the item.

  • Wow, so you are sending someone flowers? Excellent choice. SpinoutDay Flowers are dispatched via Courier Service to all capital cities and metropolitan areas only. We fully believe they will do a great job, but, of course, things can go wrong every now and again. SpinoutDay accepts no responsibility for any damage, loss or delay as a result of using this service. Couriers deliver to business addresses between 9am and 5pm (Monday to Friday) and specific times cannot be guaranteed. All SpinoutDay purchases are placed with authority to leave. Deliveries can not be made to PO Boxes. A redelivery charge of $15.50 will apply if the recipient is unavailable for receipt of delivery, if the delivery address is incorrect or if there is no safe place to leave the item. Again, take a deep breath, everything should go fine. We just need to make you aware of all these facts.

  • Ahh… you’ve chosen to send movie tickets. Let us commend you on your fine decision. Here is what you need to know. Movie Tickets are delivered via US Postal services. SpinoutDay accepts no responsibility for any damage, loss or delay as a result of using this service. We can provide you with the Express Post tracking code to contact US Postal services in the event you need to locate the whereabouts of your delivery. US Postal services only guarantees next day delivery to certain post codes nationally. To view this list, please visit US Postal services. A redelivery charge of $6 will apply if the item is lost after receipt, if the recipient is unavailable for receipt of delivery, if the delivery address is incorrect or if there is no safe place to leave the item.

  • Experience Vouchers are something very unique and excited offered by SpinoutDay. But there are a few things you need to know. Experience Vouchers are sold by SpinoutDay as agent for businesses that provide lifestyle and recreational services to customers ('Experience Providers’). SpinoutDay is not a provider of such services or experiences and has no responsibility for any services or experiences provided or not provided by the Experience Provider or any other party. SpinoutDay is your booking agent to schedule and make payment on your behalf to the Experience Provider. The Experience Providers provide services directly to customers. SpinoutDay makes no warranty or representation regarding the standard of any service to be provided. All SpinoutDay vouchers are issued subject to the terms and conditions of each Experience Provider and these SpinoutDay terms and conditions. SpinoutDay does not control the business operations of any Experience Provider. SpinoutDay make no guarantees or warranties about the services that are provided to you by the Experience Providers. 

  • Our lawyers wanted us to put the following details in here for you.

    SpinoutDay has: no liability for any act, omission or default, whether negligent or otherwise of any Experience Provider or third party. no liability for any loss or damage occasioned by any negligent act or omission of any Experience Provider or third party. Where SpinoutDay's liability cannot be excluded, such liability is limited to the value of the Gift Voucher purchased.

  • Don’t procrastinate in setting up your experience! Here’s why. All experiences are offered by Experience Providers and are subject to availability. Bookings should be made at least 3 weeks in advance. So if you wait until the last minute, you might not get the day you really want. Don’t let that happen… just make the call now! If you would like to book during peak times (such as weekends or holidays), you should book even further in advance. Remember the old saying, the early bird gets the worm! Bookings are not finalized until you have received the email entitled "Confirmation of your booking". Please be advised that some experiences display availability dates on the website. These dates are guidelines only and are subject to change. We suggest if you plan to purchase a voucher for a date listed at short notice, you contact us to ensure there is still availability before completing the transaction. SpinoutDay is not responsible in any way for any appointments made directly with any Service Provider. SpinoutDay makes no claim or guarantee as to the availability of any specific Experience. In the event that SpinoutDay no longer offers or otherwise terminates or withdraws a SpinoutDay Experience or Experience Location, you shall be entitled to exchange for another SpinoutDay Experience.

    The Experience Provider is not required to provide the services reserved if the Participant fails to provide the Experience Reservation Confirmation. In such cases, the experience(s) cannot be rescheduled and the value of the original SpinoutDay will be forfeited.

    If for any reason the Experience Reservation Confirmation is not received via email (or any other method deemed necessary by SpinoutDay) it is the responsibility of the Redeemer to contact SpinoutDay at 1 (888) 210-8802 a minimum of two business days prior to the earliest requested date of participation.

  • Again, accuracy is key. It is your responsibility to ensure you enter your email address and other contact details correctly when you complete the experience booking process on a SpinoutDay website. Failure to do so may result in loss or incorrect delivery of the email confirmation of your experience. As the Experience Provider will be expecting you, you may end up forfeiting your voucher (subject to the Experience Provider's terms and conditions).

  • Once your booking has been made, if you cancel it, you may incur a cancellation fee from the Experience Provider. Our Experience Providers have their own cancellation policies, which you are bound to follow. In the case of short notice cancellations by you, you may lose your voucher completely if the Experience Provider is unable to fill your space on the day. If an Experience Provider needs to cancel an experience for any reason, you will be notified as soon as possible in order to reschedule a convenient alternative date. SpinoutDay will not reimburse any traveling, accommodation or other expenses incurred by you or any other person in the event of a cancellation.

  • Many experiences are weather dependent. That’s part of what makes them so awesome. But what happens if it does look like the weather will interfere? First of all, you will have the Experience Provider's details so you can call to confirm whether adverse weather affects your proposed experience. We suggest you call on the morning of your experience if you have any doubt about the weather being good enough to enjoy your experience in a normal manner. The provider of the experience should be very helpful. If bad weather affects a booking, it will be rescheduled at no cost to you. Remember, you are required to reschedule, as vouchers are non-refundable.

  • Complaints? Well, we hope that never happens, but if you do have a problem or a complaint on the day of your experience, please bring this to the Experience Provider's attention immediately. Issues may be addressed on the spot, where possible.

  • 27. Insurance

    Some of the experiences we promote are considered dangerous. You should be aware of the risks involved in such experiences before you order or participate in them. SpinoutDay staff can provide further information if you are concerned about any of the experiences offered on our site.

    All Experience Providers who offer their experiences through our site warrant that they maintain appropriate public liability insurance to cover all risks associated with both their businesses and the services they provide.

    SpinoutDay does not make any warranty or representation about third party businesses offering services through our site or about those services. It is your responsibility to make independent enquiries with the Experience Provider or with other third parties to determine any need for additional insurance of your own.

  • The experiences all sound so great, don’t they? So where does all this amazing text come from? As it turns out, the independent Experience Providers provide the information about their experiences. We try to ensure that our promotional information is accurate and up-to-date. However, the content or format of some experiences may change slightly from time to time. The Experience Provider (upon confirmation of each booking) will provide the final details about each experience. The Experience Provider will notify you of any subsequent changes. Your participation in each experience is conditional upon your acceptance of the Experience Provider's terms and conditions at the time your booking is confirmed by the Experience Provider.

    Gift Boxes

    The contents of SpinoutDay Gift Boxes may change at times, and at our discretion. This may be required when certain offers are out of stock, become obsolete, or for other reasons beyond our control. We always do our best to replace changed items with something of comparable quality and value.

  • The photographs used on our websites are great, right? Well they are for editorial and illustrative purposes only. These images are to illustrate single or multi-location experiences that are provided to us by Experience Providers and are used as an indication only of the machines, vehicles, craft, venues and animals you will experience. (So don’t expect to see exactly what you see in these pictures.)

  • SpinoutDay Experience Providers are located at many of the countries best locations. We are continually adding locations, but occasionally we may need to stop featuring some venues. Where locations are described as “Nation Wide," the description is indicative only. Some experiences may not be available in remote areas.

  • The session lengths shown on individual experiences on the SpinoutDay site are approximate. They are supplied by Experience Providers as a guide to help you calculate how long you will be at the venue. Unless the experience description states otherwise, you will be among other customers at the venue, so you may find that there is waiting involved before your turn comes round. Any itinerary shown as part of the experience description on our site is indicative only; the order of events may change.

  • Can anyone participate in any experience? The fact is that certain experiences provided by Experience Providers are subject to minimum age, weight, health or other restrictions. You will know these restrictions ahead of time, as they are outlined on the relevant experience information page and also in the email of your booking confirmation. Please read this information carefully. It is your responsibility to understand any restrictions prior to confirming your booking. If you are later forced to cancel due to restrictions, you may be liable for charges by the provider of your experience.

  • SpinoutDay recognizes that persons with disabilities may have difficulty participating in certain Experiences. While certain Experiences may require certain physical abilities, SpinoutDay encourages the involvement of all persons in the Experiences to the most reasonable extent possible. To help us meet your needs, we ask that you inform us of any relevant disability before your Experience is booked.   • SpinoutDay is an agency offering experiences through third party Experience Providers, not a health or wellness provider. We do not, will not and cannot refer, endorse or recommend any specific professional services, products, or procedures to you, including those advertised on our Site. 

    This Site is not a substitute for professional advice of any kind, including health and medical advice, diagnosis, or treatment. You are responsible for seeking appropriate professional advice from your physician or another qualified health professional to answer questions about health conditions. We advise all our customers to be diligent in seeking professional advice about anything you may have read on our Site, and to always avoid unnecessary health risks.

  • Lucky you! You have a promotional offer, do you? SpinoutDay does offer promotional discounts and special offers from time to time ('Promotional Offers' or 'Promotional Codes'). If you have a Promotional Code, it should be entered at the final payment screen where prompted. By redeeming any of SpinoutDay's Promotional Codes or Promotional Offers, you agree to accept and comply with all of the following terms and conditions of use.

    • Promotional Codes are only applied if they are entered in the designated field on the shopping cart screen, before submitting an order. If the Promotional Code is not entered in said field, the discount will not be applied to the order.
    • Promotional Codes are only applicable until their expiry date. If they are used after their expiry date, no discount will be applied to the order. No extensions to expiry dates are permitted under any circumstances.
    • Only one Promotional Code may be used per person, and each Promotional Code may only be used once per person. If multiple discounts apply to the same order, the customer will receive the largest discount available.
    • We reserve the right to verify the validity of any use of a Promotional Code at any time. If we find or believe that there has been any unauthorized use of a Promotional Code, or that a customer has abused the Promotional Code system, we will immediately cease all activity on that customer's account.
    • We reserve the right to remove any Promotional Code or Promotional Offer at any time, without notice.
  • YOU EXPRESSLY AGREE THAT USE OF THIS SITE IS AT YOUR SOLE RISK.   • IN NO EVENT SHALL SPINOUTDAY, ITS SUBSIDIARIES, AFFILIATES NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, MERCHANTS, PARTNERS, THIRD-PARTY CONTENT PROVIDERS OR LICENSORS, OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, THE CONTENT, STATEMENTS AND OTHER INFORMATION CONTAINED THEREIN, THE PRODUCTS OR SERVICES ACCESSIBLE OR AVAILABLE THROUGH THE SITE OR THESE TERMS OF USE. TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNTS PAID BY YOU DURING THE SIX MONTHS PRECEDING THE BRINGING OF ANY CLAIM, OR FIVE HUNDRED DOLLARS, WHICHEVER IS LESS.

  • We will make every reasonable effort to resolve any disagreements that you have with SpinoutDay. If those efforts fail, by using this Site you agree that any claim, dispute, or controversy you may have against SpinoutDay arising out of, relating to, or connected in any way with this Agreement this Site or the purchase or sale of any SpinoutDay Gift(s) shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) and conducted before a single arbitrator pursuant to the applicable Rules and Procedures established by AAA (“Rules and Procedures”). You agree further that: (a) The arbitration, including the rendering of the award, shall take place in Miami, Florida; (b) the arbitrator shall apply Florida law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (c) there shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only your and/or SpinoutDay’s individual claims; and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (d) in the event that you are able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, SpinoutDay will pay as much of your filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (e) with the exception of subpart (c) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the Rules and Procedures established by AAA, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (c) is found to be invalid, unenforceable or illegal, then the entirety of this Arbitration Provision shall be null and void, and neither you nor SpinoutDay shall be entitled to arbitrate their dispute.

  • SpinoutDay, “ Give Happiness” and SpinoutDay’s other trademarks, and service marks and other logos and product and service names are trademarks of SpinoutDay. You may not copy, use or display in any manner such trademarks and service marks without the prior written consent of SpinoutDay. The text and illustrations (including photographs and video) used by SpinoutDay are protected by copyright and must not be copied in whole or in part with the express permission of SpinoutDay.

  • SpinoutDay, LLC is a Florida Company, herein referred to as "SpinoutDay". We reserve the right to change these terms and conditions without notice.
